Please read these Terms carefully
These Terms form a legal agreement between you and JobACE. They contain important provisions about paid subscriptions, automatic renewal, AI-generated output, ownership, disclaimers and limits of liability. Nothing in these Terms excludes a right or remedy that applicable consumer law does not permit you to waive.
1. Agreement and scope
These Terms of Use ("Terms") govern access to jobace.ca and JobACE's related applications, APIs, interview exercises, AIMS™ assessments, reports, job listings, referral, redemption, support and enterprise features (collectively, the "Services"). "JobACE", "we", "us" and "our" refer to the Ontario-based operator of the Services.
By creating an account, clicking an acceptance control, purchasing a product or using the Services, you agree to these Terms and acknowledge the Privacy Policy. The Privacy Policy describes our personal-information practices; it is not a substitute for consent where separate consent is required by law. If you do not agree, do not use the Services.
Additional written terms displayed for a plan, promotion, enterprise program or feature also apply. If they conflict with these Terms, the additional terms govern that specific offering unless they state otherwise.
These Terms are intended primarily for individual users. Institutional or other business services may be governed by a separate written agreement. Where a separate agreement applies, it governs the covered business relationship to the extent of a conflict with these Terms.
2. Eligibility and authority
The Services are intended for individuals who are at least 16 years old. By creating an account or using the Services, you represent that you are at least 16. If you have not reached the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian. JobACE does not independently verify every user's age.
The Services are offered from Ontario for users in Canada. Access from another country does not mean the Services comply with that country's laws, and you are responsible for determining whether your use is permitted there.
3. What JobACE provides
JobACE provides voice-based interview practice, generated questions, coaching, mock interviews, transcripts, progress history, structured AIMS™ scoring, assessment reports, targeted improvement drills, resume- and job-description-based preparation, job-listing links and related career-learning tools. Features and availability vary by plan, device and location.
JobACE is a practice and educational tool. We are not an employer, recruiter, employment agency, immigration adviser, lawyer, regulated career professional or representative of any company named in a lens, question or job listing. JobACE does not make hiring decisions and does not guarantee an interview, employment, promotion, score improvement or any other outcome.
4. AI-generated content and assessments
The Services use automated systems and third-party AI services for speech recognition, text-to-speech, questions, coaching, evaluation and reports. AI output and transcripts can be inaccurate, incomplete, outdated, offensive or biased. Scores and feedback are estimates based on available inputs and are not verified facts, psychological testing, professional advice or an employer's official assessment.
You must use independent judgment, verify important information and adapt suggestions to your circumstances. Do not rely on the Services as the sole basis for an employment, legal, immigration, financial, medical or other high-impact decision. If you share a report, clearly identify it as AI-assisted practice output.
Company-specific AIMS™ lenses are derived from public information and JobACE's methodology. The named companies do not sponsor, approve or certify the lenses unless JobACE expressly states otherwise in writing. Their names and marks belong to their respective owners.
5. Accounts and security
- Provide accurate, current information and keep it updated.
- Keep your credentials and sign-in links confidential. You are responsible for activity under your account except to the extent the law provides otherwise.
- Use only one personal account unless JobACE authorizes otherwise. Do not sell, transfer or share access or evade device or usage limits.
- Notify us promptly at jobace.ca@gmail.com if you suspect unauthorized access. We may require verification before restoring access.
Google Sign-In is also subject to Google's terms. Account closure is described in Section 15 and the Privacy Policy.
6. Microphone, recordings and career information
Voice features require microphone access and submission of audio for processing. You control the browser or device permission. Only record yourself, and do not record an interviewer, meeting or other person without all consent required by law.
Resumes and job descriptions can contain sensitive, confidential or third-party information. Upload only information that you have the right to use and that is reasonably necessary for practice. Remove government identifiers, financial details, health information, references' contact details and other unnecessary sensitive content.
If you join an organization-sponsored program, JobACE will separately identify the receiving organization, purpose and data categories before program information is shared. Private practice sessions, raw audio and full transcripts are not shared unless they are specifically identified in that notice and authorization.
7. Your content and licence to JobACE
As between you and JobACE, you retain any rights you have in recordings, transcripts, resumes, job descriptions, messages and other content you submit ("User Content"). You grant JobACE a non-exclusive, worldwide, royalty-free and limited licence to host, reproduce, transmit, transcribe, analyze, transform and display your User Content solely as necessary to provide, maintain, secure and support the Services, comply with applicable law, and carry out other purposes you expressly authorize. This licence may be sublicensed only to service providers acting on our behalf for those purposes and lasts only while the content is retained for those purposes.
We may use aggregated or appropriately de-identified information to analyze and improve the Services as described in the Privacy Policy. This licence does not authorize use of identifiable User Content to train a model for a separate purpose without additional authorization where required.
You represent that you have the rights and permissions needed for your User Content and that our permitted processing will not violate another person's rights or law. Do not submit trade secrets, employer interview materials subject to confidentiality, unlawfully obtained job content, or content that infringes privacy, copyright or other rights.
If you choose to share a report, referral message or other content, you are responsible for the recipients and context. Public or third-party sharing is not controlled by JobACE after disclosure.
8. Acceptable use
You must not, directly or through another person:
- use the Services unlawfully, fraudulently or to harm another person;
- impersonate a person, misrepresent credentials, facilitate cheating or present generated output as independently verified evidence;
- upload malware, unlawful content, personal information without authority, or material that infringes intellectual-property, confidentiality, publicity or privacy rights;
- probe, disrupt, overload, bypass security or usage limits, access another account, or interfere with the Services or their networks;
- scrape, crawl, use bots, automate access, harvest job listings or accounts, or use output to build or train a competing model or service without our written permission;
- reverse engineer, decompile, discover source code, extract models, prompts, scoring rules or datasets, except to the limited extent a prohibition is not permitted by law;
- resell, sublicense or commercially exploit the Services except under a written agreement with JobACE; or
- help or attempt to help anyone do any of the above.
9. Free access, trials, credits and promotions
JobACE may offer guest access, free quotas, promotional trials, credits, referral rewards or redemption codes. Trial duration, eligibility, included features, expiry and restrictions are those displayed with the applicable offer and may vary. If a trial converts to a paid subscription, the renewal price, billing date and billing period will be disclosed in the offer or checkout flow before payment authorization. Unless required by law, promotional value has no cash value, is non-transferable, cannot be combined or resold, and may be withheld or reversed for mistake, abuse, duplicate accounts, same-device activity, self-referral or fraud.
JobACE may modify or end a no-charge program prospectively. We will not retroactively take away a paid entitlement except where necessary to correct fraud, chargeback, error or a legal violation.
10. Prices, payment and taxes
Paid features may be sold as one-time credit packages or recurring subscriptions. Before purchase, the checkout will display the selected product, price and currency, billing frequency if recurring, applicable taxes or charges, and material restrictions. You authorize JobACE and Stripe to charge the payment method for the amounts you approve.
Prices may change prospectively. A price change does not affect a completed one-time purchase and will normally apply to a subscription beginning with a future renewal period after reasonable advance notice. You are responsible for applicable taxes unless checkout states they are included.
Keep an electronic copy of these Terms and the checkout confirmation. Contact us promptly if you do not receive a receipt or believe a charge is incorrect.
11. Subscriptions, automatic renewal and cancellation
A recurring subscription renews automatically for the billing period disclosed at checkout until cancelled. Stripe will charge the stored payment method at each renewal at the then-applicable price, plus tax, after any notice required by law. If payment fails, access may be limited or the subscription may be cancelled.
You may cancel through the account subscription controls or by contacting jobace.ca@gmail.com. Unless the cancellation interface offers and you select immediate cancellation, cancellation takes effect at the end of the current paid billing period and access continues until then. Cancelling does not automatically refund charges already paid.
Where a Premium offer is described as "unlimited", it means unlimited mock-interview practice during an active Premium subscription, subject to reasonable technical, security and fair-use restrictions. Certain AI, voice, credit-based or third-party features may have separate limits disclosed in the applicable plan or checkout. Fair-use restrictions are intended to prevent automated extraction, resale, account sharing and other abusive use, not ordinary individual practice.
12. Refunds and statutory cancellation rights
Except as required by applicable law or expressly stated at checkout, subscription fees and credits are generally non-refundable once the applicable service period has begun or the credits have been used or made available. Cancelling a subscription prevents future renewal charges but does not automatically generate a refund for the current billing period. Nothing in these Terms limits any non-waivable cancellation, refund, reversal, cooling-off or other consumer right.
To request a refund or exercise a statutory right, email jobace.ca@gmail.com with the account email, transaction date, product and reason. Do not send full card details. Refunds, when due, are made to the original payment method where practicable. We may deduct or deactivate refunded credits or benefits to the extent permitted by law. Contact us about duplicate or incorrect charges, a paid service that was not supplied, or a material service failure so that we can review an appropriate correction, credit or refund.
13. Third-party services and job listings
The Services rely on or link to third parties such as OpenAI, Google, Stripe, hosting and email providers, employers and job boards. Third- party services are governed by their own terms and privacy practices. Job listings may be imported, generated, summarized or corrected from external material and may be incomplete, expired or inaccurate. Verify a role and application instructions directly with the employer and never pay or disclose sensitive information based only on a listing.
JobACE is not responsible for a third party's service, content, hiring process, availability or conduct, but this does not limit responsibility that law does not allow us to exclude.
14. JobACE intellectual property
The Services, including software, interfaces, designs, prompts, selection and arrangement of content, AIMS™, the AIMS Lens Engine, assessment frameworks, rubrics, scoring methodologies, workflows and related names and logos, are owned by JobACE or its licensors and protected by applicable law. Subject to these Terms, JobACE gives you a limited, personal, revocable, non-exclusive and non-transferable right to use the Services during the applicable access period. You may use and share reports made available to you for personal interview preparation, training and professional development, subject to third-party rights and any restrictions displayed with the report.
No right is granted except as expressly stated. Feedback or suggestions you voluntarily provide may be used by JobACE without restriction or compensation, provided we handle personal information under the Privacy Policy.
15. Suspension, closure and effect of termination
You may stop using the Services at any time and may close your account through available account controls. Delete practice sessions you do not want retained before closing the account. The current closure process deactivates the account and deletes, de-identifies or restricts access to certain account information. Some practice, transaction, fraud-prevention, security, backup or legal records may remain as described in the Privacy Policy. Closing an account does not necessarily delete every record associated with prior use of the Services.
We may limit, suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay, or used the Services fraudulently or abusively. Where reasonable and not prohibited by law or urgent risk, we will provide notice and an opportunity to address the issue. Mandatory consumer rights, accrued payment obligations and provisions intended by their nature to survive termination remain in effect.
16. Changes to the Services or these Terms
We may improve, replace or discontinue features. If we discontinue a material paid feature during a prepaid service period, we may provide a reasonable substitute, service credit or prorated refund, as appropriate and subject to applicable law. We may post non-material updates by revising these Terms and their effective date. We will provide reasonable advance notice of material changes by email, through the Services or by another prominent method. Where a change requires new consent under applicable law, it will not apply to the relevant processing until that consent has been obtained. Changes do not retroactively alter a dispute that arose before the change.
17. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available". JobACE does not warrant that the Services or AI output will be uninterrupted, error-free, secure, accurate, suitable for a particular employer or compatible with every device. To the maximum extent permitted by law, we disclaim implied warranties and conditions, including merchantable quality, fitness for a particular purpose, title and non-infringement.
Some provinces do not permit certain exclusions, and those exclusions apply only to the extent permitted. Nothing in these Terms excludes a statutory warranty, condition or liability that cannot lawfully be excluded.
18. Limitation of liability
To the maximum extent permitted by law, JobACE and its directors, personnel, affiliates and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of opportunity, employment, income, data, goodwill or business, arising from the Services, even if advised that such loss was possible.
To the maximum extent permitted by law, their total aggregate liability for claims arising from the Services will not exceed the greater of CAD $100 and the amount you paid JobACE for the Services giving rise to the claim during the 12 months before the event. These limits do not apply to fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, breach of an obligation that law does not permit us to limit, any privacy or data-security remedy that law does not permit us to limit, or mandatory consumer remedies.
19. Governing law and disputes
Please contact jobace.ca@gmail.com first so we can try to resolve a concern informally. Except where mandatory local law provides otherwise, these Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules. Subject to mandatory law, the courts located in Ontario have jurisdiction.
If you are a consumer residing in Quebec, these Terms are governed to the extent required by the mandatory laws of Quebec and the applicable federal laws of Canada. Nothing in these Terms limits a non-waivable right or jurisdiction available under applicable consumer-protection law. These Terms do not require arbitration or waive participation in a class proceeding where such a restriction is prohibited.
20. General terms
These Terms, the Privacy Policy and applicable offer terms are the entire agreement about the Services. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, financing, reorganization or sale, subject to applicable law. Neither party is liable for delay caused by events beyond reasonable control, except payment obligations.
Electronic acceptance, records and notices satisfy writing requirements to the extent permitted by law. Service and transaction notices may be sent to your account email. Marketing messages are subject to your choices and applicable anti-spam law. Headings are for convenience only.
